If you believe you have been subjected to discrimination, harassment, intimidation, or bullying, you should immediately contact the school principal and/or the appropriate District personnel, which you can find in the Title IX/IV Coordinators section in the sidebar.

Title VI: Civil Rights Act of 1964

Every student has a protected right to feel safe at school.

It is the right of all students to be free from discrimination from other students and adults at school.

Under Title VI, students have the federally-protected right to an education free from discrimination and harassment. It protects everyone participating in programs that receive federal funding from discrimination based on their race, color, or national origin. This protection extends to all federally-financed programs, including both public and non-public schools, and is therefore under the jurisdiction of the U.S. Department of Education and is enforced by the Office for Civil Rights.

A few things to know about Title VI:

  • Discrimination can come from other students AND/OR adults at school.
  • Students could be discriminated against at any age.
  • Discrimination against students based on their religion can be considered a Title VI violation when their religion relates to their ethnic heritage.
  • A school violates a student’s Title VI rights when it fails to appropriately remedy a hostile climate or inequity in treatment due to race, color, or national origin.
  • You don't need to be the victim or their parent/legal guardian in order to file a Title VI complaint with the Office for Civil Rights on their behalf.

Non-Discrimination

Petaluma City Schools is committed to providing equal opportunity for all individuals in district programs and activities. District programs, activities, and practices shall be free from unlawful discrimination, including discrimination against an individual or group based on race, color, ancestry, nationality, national origin, immigration status, ethnic group identification, ethnicity, age, religion, marital status, pregnancy, or parental status, physical or mental disability, sex, sexual orientation, gender, gender identity, gender expression, or genetic information; a perception of one or more of such characteristics; or association with a person or group with one or more of these actual or perceived characteristics.

Title IX/Non-Discrimination: Prohibiting Sex-Based Discrimination

Title IX of the Education Amendments of 1972 (“Title IX”) is a federal law that prohibits sex-based discrimination in all educational programs and activities, including athletic programs. No person shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any educational program or activity operated by the District. Title IX protects all participants in the District's educational programs and activities, including students, parents, employees, and job applicants. The District does not discriminate on the basis of sex. Discrimination on the basis of sex can include sexual harassment and sexual violence.

In addition to Title IX, the California Education Code prohibits discrimination on the basis of sex in schools. (California Education Code §§ 220-221.1.) Other state and federal laws also prohibit discrimination and ensure equality in education.

Title IX information provided here applies to every school and site in the District. 

You have the following rights under Title IX, to the extent applicable at the District. You have the right to receive equitable treatment and benefits in the provision of any of the following.

  • You have the right to fair and equitable treatment and you shall not be discriminated against based on your sex.
  • You have the right to be provided with an equitable opportunity to participate in all academic extracurricular activities, including athletics.
  • You have the right to inquire of the athletic director of your school or appropriate District personnel as to the athletic opportunities offered by the school.
  • You have the right to receive equitable treatment and benefits in the provision of all of the following related to athletics, if provided by the District:
    • Equipment and supplies;
    • Scheduling of games and practices;
    • Transportation;
    • Access to tutoring;
    • Coaching;
    • Locker rooms;
    • Practices and competitive facilities;
    • Medical and training facilities and services; and
    • Publicity.
  • You have the right to have access to a sex/gender equity coordinator, referred to as the Title IX Coordinator (find contact information above), to answer questions regarding sex/gender equity laws.
  • You have the right to contact the State Department of Education and the California Interscholastic Federation to access information on sex/gender equity laws.
  • You have the right to file a confidential discrimination complaint with the United States Department of Education Office for Civil Rights or the California Department of Education if you believe you have been discriminated against or if you believe you have received unequal treatment on the basis of your sex.
  • You have the right to pursue civil remedies if you have been discriminated against.
  • You have the right to be protected against retaliation if you file a discrimination complaint.

The District has a responsibility to respond promptly and effectively to sex-based discrimination, including sexual harassment and sexual violence. If the District knows or reasonably should know about sex discrimination, it must take action to eliminate the sex discrimination, prevent its recurrence, and address its effects. The District must resolve complaints of sex discrimination promptly and equitably. Information on filing a complaint alleging sex-based discrimination is below, including contact information for the District's Title IX Coordinators.

Complaints Subject to UCP

The district's uniform complaint procedures (UCP) shall be used to investigate and resolve complaints regarding the following programs and activities:

  1. Accommodations for pregnant and parenting students  (Education Code 46015)
  2. Adult education programs  (Education Code 8500-8538, 52334.7, 52500-52617)
  3. After School Education and Safety programs  (Education Code 8482-8484.65)
  4. Agricultural career technical education  (Education Code 52460-52462)
  5. Career technical and technical education and career technical and technical training programs  (Education Code 52300-52462)
  6. Child care and development programs  (Education Code 8200-8488)
  7. Compensatory education  (Education Code 54400)
  8. Consolidated categorical aid programs  (Education Code 33315; 34 CFR 299.10-299.12)
  9. Course periods without educational content  (Education Code 51228.1-51228.3)
  10. Discrimination, harassment, intimidation, or bullying in district programs and activities, including in those programs or activities funded directly by or that receive or benefit from any state financial assistance, based on a person's actual or perceived characteristics of race or ethnicity, color, ancestry, nationality, national origin, immigration status, ethnic group identification, age, religion, physical or mental disability, medical condition, or genetic information; any other characteristic identified in Education Code 200 or 220, Government Code 11135, or Penal Code 422.55; or based on the person's association with a person or group with one or more of these actual or perceived characteristics  (5 CCR 4610) Discrimination includes, but is not limited to, the Board's refusal to approve the use or prohibit the use of any textbook, instructional material, supplemental instructional material, or other curriculum for classroom instruction, or any book or other resource in a school library, on the basis that it includes a study of the role and contributions of any individual or group consistent with the requirements of Education Code 51204.5 and 60040, unless such study would violate Education Code 51501 or 60044. Additionally, discrimination includes, but is not limited to, the Board's adoption or approval of use of any textbook, instructional material, supplemental instructional material, or other curriculum for classroom instruction, or any book or other resource in a school library if the use would subject a student to unlawful discrimination pursuant to Education Code 220. A complaint alleging such unlawful discrimination may, in addition to or in lieu of being filed with the district, be directly filed with the Superintendent of Public Instruction (SPI).  (Education Code 243, 244)
    The UCP shall not be used to investigate and resolve employment discrimination complaints.  (5 CCR 4611)

  23. Any complaint alleging retaliation against a complainant or other participant in the complaint process or anyone who has acted to uncover or report a violation subject to this policy
  24. Any other state or federal educational program the SPI or designee deems appropriate

Complaints filed under the District's Uniform Complaint Procedure will be investigated and a decision made within sixty (60) calendar days of the District's receipt, unless the complainant agrees to an extension. The District's compliance officer or designee may interview alleged victims, alleged offenders, and relevant witnesses. The compliance officer may review available records, statements, or notes related to the complaint, including evidence or information received from the parties during the investigation. The compliance officer may visit reasonably accessible locations where discrimination is alleged to have occurred. As appropriate, the District's compliance officer periodically will inform the parties of the status of the investigation. The complainant will be notified when a decision is made. The compliance officer will prepare and send a final written decision to the complainant and respondent, if any, within sixty (60) calendar days of the District's receipt of the complaint (unless the complainant agrees to an extension).

If the complainant or respondent is not satisfied with the decision, either the complainant or respondent may, within five business days, file the complaint in writing with the Board. The Board may consider the matter at a Board meeting or decide not to hear the complaint, in which case the compliance officer’s decision shall be final. The complainant or respondent may appeal the District's decision within fifteen calendar days to the California Department of Education. The appeal must specify the reason for the appeal and whether the District's facts are incorrect and/or the law is misapplied. The appeal must include a copy of the original complaint to the District and a copy of the District's decision. For complaints alleging unlawful discrimination based on state law, the complainant may pursue available civil law remedies, including seeking assistance from mediation centers or public/private interest attorneys, sixty calendar days after filing an appeal with the California Department of Education. (California Education Code § 262.3.) Note that this sixty-day moratorium does not apply to complaints seeking injunctive relief in state courts or to discrimination complaints based on federal law. If the compliance officer finds that a complaint has merit, the District will take appropriate corrective action.

NOTICE TO PARENTS/GUARDIANS, PUPILS, AND TEACHERS: COMPLAINT RIGHTS

 Parents/Guardians, Pupils, and Teachers: Pursuant to Education Code section 35186, you are hereby notified that: 

1. There should be suficient textbooks and instructional materials. For there to be sucient textbooks and instructional materials, each pupil, including English learners, must have a textbook or instructional material, or both, to use in class and to take home. 

2. School facilities must be clean, safe, and maintained in good repair. 

3. There should be no teacher vacancies or misassignments. There should be a teacher assigned to each class and not a series of substitutes or other temporary teachers. The teacher should have the proper credential to teach the class, including the certication required to teach English learners, if present. Misassignment means the placement of a certicated employee in a teaching or services position for which the employee does not hold a legally recognized certicate or credential or the placement of a certicated employee in a teaching or services position that the employee is not otherwise authorized by statute to hold. Teacher vacancy means a position to which a single designated certicated employee has not been assigned at the beginning of the year for an entire year or, if the position is for a one-semester course, a position to which a single designated certicated employee has not been assigned at the beginning of a semester for an entire semester. 

4. A complaint form can be obtained at the school office or district office, or downloaded from the school or district website.
